Hoping to minimise harassment of property owners and curb corruption at various levels,the Municipal Corporation of Delhi (MCD) has decided to simplify the existing procedure of mutation of property.
As a first step,the Property Tax department of the MCD has said all mutation cases will be completed and disposed of within one month of the initiation of the process till now the process takes nearly one year to be over.
The MCD has also written to the Ministry of Urban Development (MoUD),requesting an amendment that will enable the Corporation to claim a fee on registration of property in cases of general power of attorney.
Unlike in other cases of mutation,the registration fee for general power of attorney is not shared between the Corporation and the Delhi government.
As per MCD records,the civic body at present loses up to Rs 100 crore due to this.
A slew of measures have been announced to make the process of mutation easier. For instance,in case of sale deed applications for mutation,the assessing officer will complete the procedure at the earliest without asking too many questions.
The Corporation also plans to treat all unregistered wills at par with registered wills. In addition,those seeking mutation in case of registered wills will no more need to avail No Objection Certificates from other legal heirs of the property.
What is property Mutation?
Mutation of property means recording the transfer of title of a property from a person to another in the revenue records of the municipal body. Transfer cases include the sale,exchange,gift,mortgage or lease (for over 30 years),of any immovable property. As per the provisions of the Delhi Municipal Act,the mutation of property or the change of name is done for the purpose of payment of property tax. The mutation procedure further requires a fee in the form of transfer duty to be paid through the office of the registrar.
State,MCD share revenue
In mutation cases of immovable property,the revenue generated is shared between the Delhi government and the MCD the state retains 1.5 per cent of the amount as collection charges.
In case of general power of attorney,however,the state government does not share any revenue,claiming the power of attorney is not equivalent to a transfer deed.
The MCD has now requested the MoUD to bring about an appropriate agreement enabling it to claim a share in the same.
