In a fresh twist to the sexual harassment case against TERI director-general R K Pachauri, an industrial appellate tribunal has issued a stay on the proceedings based on the report filed by the Internal Complaints Committee of TERI against him.

The court of the industrial tribunal at Karkardooma district court issued a stay on proceedings arising out of the report filed by the ICC in May, which had held that Pachauri’s “repeated attempts” to foster a personal relationship with a young woman colleague caused her “harassment”.

It further said that when the woman tried to resist, the accused “retaliated by taking away her work”. The panel recommended that the complainant be paid monetary compensation for the recurring expenses required to treat her stress-related symptoms.

Pachauri had challenged the panel’s recommendations before the industrial tribunal, claiming that the committee had “violated principles of natural justice” as it had “withheld anonymous statements from unknown witnesses and rushed the enquiry”.

Pachauri’s plea also claimed that the ICC had not allowed him access to documentary evidence contained in his laptop and mobile phone.
