A court has recommended an inquiry into persons authorised to attest documents in the Tis Hazari courts complex after it found that an affidavit filed before it in a case was attested without the presence of the person making the affidavit and the seal and signature of the oath commissioner on the paper were fake.
Special CBI Judge Anu Malhotra sent a report to the office of the District and Sessions Judge,Delhi,for consideration,after it was found that the stamp of the oath commissioner on a travel itinerary submitted by an accused,who wished to go abroad,was fake.
The court discovered that the attestation was fake when the oath commissioner,who had been summoned to verify the signature,told the court that the stamp and the seal on the paper were not his and that he did not have any record of having attested the document.
The accused and his lawyer admitted before the court that they had not signed the paper in the presence of an oath commissioner. The lawyer also admitted that he had sent his clerk to get the paper attested after having signed it in court due to paucity of time.
The two tendered an unconditional apology for submitting the paper and the lawyer told the court he will be more vigilant in the future.
