Final verdict in second Nithari case today

Special CBI Judge Rama Jain will deliver a final judgement in the Arti murder and rape case on Wednesday. Arti (7) disappeared on September 25,2006 and is one of the 19 victims who were allegedly murdered and raped by Surinder Koli,the domestic help of Moninder Singh Pandher.

This will be the second verdict in the Nithari killings cases.

Though,Durga Prasad,Arti’s father,wanted Pandher as an accused in the case,his lawyers feel it is too late to accuse the 55-year-old businessman. “I spoke to my lawyers today and asked them why Pandher had not been made an accused in the case. They said that at this stage they can file a petition in the Allahabad High Court on the basis of the Rimpa Haldar case but not in the CBI court,” Prasad said.

His lawyers,Praveen Kumar in the Supreme Court and Manoj Kumar in the Ghaziabad court,said it is too late to make Pandher an accused in the case. “On the basis of statements given to the CBI by Prasad,Pandher was not made an accused in the case. Now,accusing him in this murder and rape case is not possible. Moreover,Surinder Koli has already admitted to committing the crime. We are confident the court will pronounce the right judgement in this case as well. The court may reserve a date to pronounce the quantum of punishment,” Praveen Kumar said.

Arti was studying in kindergarten in Nithari village and had come home from school around noon. She went out again around 12.30 pm,having told her ailing mother she would attend to her after buying sweets from the shop.

But she did not come back till the evening and the Sector-20 police station was informed around 2.30 am.

Surinder Koli is the accused in this case. The CBI has given Pandher a clean chit in 16 chargesheets filed. On February 13,the special CBI court had convicted him and Koli for the murder and rape of 14-year-old Rimpa Haldar.
