The AAP government on Thursday started its arguments on the issue of Article 239AA and the distribution of power between the elected government in the capital and Lieutenant Governor Najeeb Jung.
Appearing before the bench of Chief Justice G Rohini and Justice Jayant Nath, senior advocate Dayan Krishnan said that the Delhi cabinet was not obliged to take the approval of the Lt Governor about its decisions, and was only required to inform him.
The AAP government has maintained that as it was the elected government of the capital, the Lt Governor was required to keep the chief minister or the chief secretary informed before issuing any directions or orders.

Presenting his arguments on the constitutional provision, Krishnan also referred to the conduct of business rules of the GNCT Act.
The lawyer also argued that the Lt Governor was required to consult the elected chief minister even to take decision on issues concerning police, land and law and order, even though these were not state subjects.
The arguments are set to continue on Monday.
On Wednesday, the high court bench had decided to hear final arguments on the issue of interpretation of Article 239AA of the Constitution after taking note of the cases filed over the turf war between Jung the AAP government regarding the decision-making authority over various issues. The court has indicated that it will hold daily hearings to dispose of the case.
