DDA flat scam: Chargesheet pins five,more to follow

The Economic Offences Wing of Delhi Police filed a chargesheet against five accused in the multi-crore DDA housing scam in Rohini courts on Wednesday.

The Economic Offences Wing (EOW) of Delhi Police filed a chargesheet against five accused in the multi-crore DDA housing scam in Rohini courts on Wednesday.

The EOW,which conducted the investigation for more than 90 days,filed the chargesheet under IPC Sections 419 (cheating by impersonation),420 (cheating and dishonesty),468 (forgery for purpose of cheating) and 471 (using forged document),201 (destruction of evidence) and 34 (common intention). The chargesheet names Laxmi Narain Meena,Deepak Kumar (both agents),Mithun Lal Gautam (former DDA employee),Raju Ram,and Vijay Patanjali (both financers in the scam).

“The chargesheet has been filed in the first FIR (number 2/09) registered on January 9; chargesheets in two other cases registered in this regard would be filed later,” a senior officer said. “The accused persons have been referred to as planners and executors of the scam.”

The EOW has not chargesheeted Suresh Kumar Meena in this case. Officials said a supplementary chargesheet would be filed later as he was arrested late into the police probe.

A source said the EOW has given a clean chit to DDA officials,adding that forensic examinations are still on to know whether DDA officials were in any way involved.

Testimony of witnesses,documentary proof
The 174-page chargesheet says the five accused were “involved in fraudulently getting a large number of DDA forms filled by inducing poor and illiterate persons to corner maximum number of flats”. The EOW has reportedly substantiated the chargesheet with testimony of 150 witnesses and documentary evidence including forged documents,DDA forms filled by accused persons,forged PAN cards,identity proofs and bank documents among other documents.

The witnesses include the victims,their relatives,and persons who the accused contacted to get the forms filled,a police officer said. The police have submitted 8,000 pages of report,including the 174-page chargesheet,which involves all documentary evidence and statements of witnesses.

The police have also taken statements of all 5,238 applicants who were allotted flats in the DDA scheme. The source said,“We are yet to find any irregularity in the forms submitted by the successful allottees.”

The court has accepted the chargesheet and it would be put for consideration on Thursday.

Meanwhile,one of the main accused,former DDA official M L Gautam,has reportedly applied for bail.

According to the source,while separate chargesheets would be filed in the cases registered on January 17 and 19,Dinesh Drall,arrested for forgery,would also be chargesheeted later.

The irregularities were noticed last October when one of the accused,Deepak Kumar,had alerted the police about the scam following a feud over the booty.
