HC upholds acquittal in murder case
The Delhi High Court has upheld a lower court verdict of acquittal of a youth for the murder of a girl in Delhi zoo in 2004. “The trial court has considered each and every aspect in a well-reasoned judgement and due weightage has to be given to the view of the trial court in matters of appreciation of evidence, keeping in mind that it is the appeal of the state against the acquittal by the trial court,” a division bench of Justices Sanjay Kishan Kaul and Ajit Bharihoke observed in their November 27 judgment. Delhi Police had filed an appeal against the trial court verdict passed in 2007,in which the accused Nikhil Chaudhary was absolved of the charges of murdering the deceased,Kanchan. BRPL petition
Instead of going in appeal against the Delhi Electricity Regulatory Commission’s (DERC) decision to penalise it Rs 1.68 crore for “failing to maintain grid discipline,” earlier this summer, discom BRPL has adopted a novel approach. “We’ve handed over a cheque of the amount to the DERC,but at the same time,we have also submitted a petition for reviewing the decision to impose a penalty. We hope the commission will take a magnanimous stand on the issue,” said Gopal Saxena,CEO,BRPL. Since the discom cannot pass the penalty cost under its financial costs and has to bear it out of its own share of profits, the hope at BRPL is that the DERC may still revoke its decision to charge the penalty.
