PCPNDT case: Bail for four Ruby Hall doctors

A court here on Tuesday granted bail to four Ruby Hall Clinic doctors in a case of using sonography machines without registration.

A court here on Tuesday granted bail to four Ruby Hall Clinic doctors in a case of using sonography machines without registration. They include hospital managing trustee and chief cardiologist Dr Parvez Grant,medical director Dr Sujata Malik,chief executive officer Bomi Bhote and deputy director (cath lab) Dr C N Makhale.

Judicial magistrate first class (JMFC) R L Wankhade granted bail to the four against a personal bond of Rs 15,000 each.

The court had summoned them on a private criminal complaint filed by Dr Kishore Pakhre,Pune Municipal Corporation’s (PMC) appropriate authority for cases under the Pre-conception Pre-natal Diagnostic Techniques Prevention (PCPNDT) Act on June 4. The complaint said two unregistered sonography machines sealed by the PMC from Ruby Hall Clinic were allegedly used for sex determination.

The doctors,through their lawyer Sagar Kothari,submitted to the court that they had bought the sonography machiches in 2001 and 2004.

“We have been sending the registration and renewal papers to the PMC time and again and we do not know why is it ‘unregistered’ according to the PMC.

Moreover,it was 10 years after buying the machines,in 2011 that the PMC requested us for documents of the machine and its usage,” they told the court.

They said in their bail pleas that the PMC had mentioned only about the unregistered sonography machines and not about illegal sex determination in the private criminal complaint against them,which the court took cognisance of.

The PMC lawyer objected to the argument,saying that the machines were used for carrying out illegal sex determination tests.

The machines were sealed by the PMC on May 17.
