PCA orders action against SHO,S-I for ‘sitting’ over case for five months

According to a PCA order,Zirakpur resident Gulshan Kumar Goyal had filed a complaint with the PCA on November 16,2012,alleging that two people had illegally extended the rent deed of his mother’s house in Gobindpura,Manimajra. Goyal also alleged that his mother’s tenants forged her signatures and attempted to use her house in a residential area for commercial purposes.

Goyal,in his complaint,mentioned that a written complaint was submitted at the public window of the senior superintendent of police (SSP),Police Headquarters,Sector 9,in August,2012.

The SSP had reportedly ordered Yashpal to take adequate action in the case. However,when the complainant did not receive any response for over two months,another complaint was filed at the public window in October,2012.

The SHO sought legal opinion in the case on November 11,2012,following which a case of cheating was registered in February.

“It appears that after the complainant filed a complaint with the PCA in November 2012,the SHO registered an FIR in the case in February. This shows the SHO’s willful inaction and malafides. He dragged the inquiry for more than five months,giving undue advantage to the offenders and has blatantly abused his power as SHO,” reads the PCA order.

S-I Ramesh Kumar has been accused of not arresting any accused named in the FIR. “Thanks to the biased conduct and malafides of the SI,the investigation in the case appears to be deadly slow. The SI,by his inaction,is shielding the accused,” the order further read.
