Ludhiana court sends dismissed DSP Balwinder Singh Sekhon, aide to judicial remand

The high court had taken the suo moto action against the duo for contempt of court after social media videos purportedly showed Sekhon levelling “personal allegations” against the judges of a bench who were hearing drug-related cases of Punjab.

A local court of Ludhiana on Thursday sent dismissed Punjab Police DSP Balwinder Singh Sekhon and his aide Pardeep Sharma to judicial remand in the alleged case of using derogatory and offensive language against the judges of a Punjab and Haryana High Court bench which was hearing drug-related matters.

Advocate Sachin Arora, counsel for Sekhon, said that the duo was sent to Model Jail, Burail of Chandigarh. “Their three-day police remand ended today. Police were seeking it (remand) for five more days, but the court declined. The two have been sent to Burail jail,” Arora said, adding that his application to shift them from Burail jail to some other jail in Punjab was also declined by the court.

Taking suo motu cognisance of the matter in February this year, the Punjab and Haryana High Court had ordered the arrest of the duo and had sentenced the two to six-month simple imprisonment for contempt of court. Later, on March 22, the Ludhiana police had registered an FIR against the duo in the matter.

An FIR against the duo was registered on March 22 under Sections 153-A (promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc.), 505 (statements conducing to public mischief), 506 (criminal intimidation) and 120-B (conspiracy) of the IPC at the division number 5 police station.

The FIR stated that on February 20, Sekhon, who was present in the Ludhiana court complex, “uploaded a video on social media via a web channel in which he used derogatory language against judges of the high court to mislead the people”.

On February 24, when the high court pronounced six-month imprisonment for the duo, Sekhon had allegedly shouted “Judicial gundagardi murdabad (down with judicial highhandedness)” in the open court.
