In its third order against the Station House Officer (SHO) of Sector-31 police station,the Police Complaints Authority (PCA) has recommended issuance of warning to the police officer and a Sub Inspector (SI) in a harassment case.
Balwant Kumar,resident of Ram Darbar,alleged that SHO Jaspal Singh accompanied by SI Randhir Singh and a few constables had visited his house on December 19,2011,at 2.20am,and wanted to take him to the police station. Parlad,Kumars brother,called up the PCR as there was no reason to take Kumar to the police station.
However,they returned after 10 minutes and started beating Parlad and allegedly took both to the police station.
The duo was released at 3.30 am after threatening them that they would be implicated in a false case if they disclosed the issue.
The police in their reply stated that a case of robbery was pending against Balwant Kumar,and he was also an accused in another where twenty people were arrested.
The police claimed that Kumar and his brother were brought to the police station for identification.
The explanation given by the Police does not appear to be correct and reliable. The complainant was arrested for a case registered four months ago,and there was no reason to arrest him again for the case. In the second case,where twenty people were arrested,the complainants name was not among them, read the PCA order.
The order further stated that the explanation given by the police on bringing the complainant to the police station at night appeared to be false and fictitious.
It is evident that the complainant has been harassed by bringing him and his brother to the police station for no apparent and valid reason.
There was no requirement for identification by anyone at such an odd hour. The police officers grossly abused their powers and have acted in an arbitrary and high-handed manner, the order further read.
The PCA had requested the UT Inspector General to issue a warning to Inspector Jaspal Singh and SI Randhir Singh for their misconduct.
