In a significant development,the Haryana Government has abolished the distinction between technical and non-technical posts by promulgating an ordinance to this effect. The decision will impact thousands of government employees battling to get technical status. The Haryana (Abolition of Distinction of Pay Scale between Technical and non-technical Posts) Ordinance has been promulgated with retrospective effect from February 1,1981 and will be applicable to all government services.
The ordinance says that higher payscales were given to persons with technical qualifications whereas all these persons were covered under the common category posts and given payscales as per qualification under the service rules. However,the employees say that the government had earlier created a clear distinction between technical and non-technical staff and removal of this distinction would adversely affect those who having technical qualifications and deserved to be treated better.
The move is seen as a hasty one with the government not awaiting Assembly session before issuing the ordinance.
This order will be applicable to group C and D in different departments of the state government besides boards and corporations. The pre-revised scales which have been covered under this ordinance include pay scale of Rs 480-760 prescribed by the government with effect from February 2,1981; Rs 1200-2040 with effect from January 1,1986; Rs 4000-6000 (January 1,1996); Rs 5200-20200 (January 1,2006); Rs 950-1400 (May 1,1990); Rs 3050-4350 (January 1,1996) and Rs 5200-20200 (January 1,2006).
In this case technical qualifications would mean Matric with ITI/Polytechnic or non-Matric with ITI/Polytechnic whichever was prescribed at the time of appointment. The ordinance says,Notwithstanding anything contrary contained in any service rules,instructions etc,all persons serving on various posts in different services under the state shall be entitled to get the payscales prescribed for those posts only under the relevant rules,notifications and instructions issued from time to time and no person who is serving or has served on any post in any service under the state,shall be entitled to a higher payscale on account of possessing a technical qualification…
So that there is no challenge to this order,the ordinance states,No suit,prosecution or any legal proceedings shall lie against the state government,boards or corporations or any officer,employee for anything,which is done or intended to be done in good faith under this ordinance. No civil court shall have the jurisdiction to entertain any suit or proceedings in respect of any matter arising under or connected with the ordinance.
