Terming it a serious offence,the Punjab and Haryana High Court on Monday issued a notice to Gopal Kanda,Minister of State for Home Affairs,Haryana,on a petition seeking registration of an FIR against the minister and his brother Govind Kanda for allegedly assaulting one Pradeep Godara,a resident of Sirsa.
After a lower court of Sirsa turned down a request to register an FIR against Kanda,the petitioner demanded relief from the High Court on Monday. Godara sought directions for registration of an FIR against Kanda,his brother and Haryana Police officers. A close associate of former chief minister Om Prakash Chautala,the petitioner is a worker of Indian National Lok Dal (INLD). Arguing on behalf of the petitioner,Advocate N S Shekhawat vehemently demanded that an FIR be registered.
He apprised the court that a Judicial Magistrate (First Class) of Sirsa had turned down the request and agreed to entertain the criminal complaint on judicial side moved by Pardeep. Shekhawat argued that there has been total failure on the part of the administration to take necessary follow up action and to uncover the crime in all its aspects. Culprits have openly challenged the rule of law and committed a serious crime. The culprits are extraordinarily resourceful.
Raising doubts about whether a fair investigation would be carried out by the Haryana police,Shekhawat further submitted that the investigation of the case should be moved out of the state. Shekhawat demanded that the Magistrate be directed to send the complaint given by the petitioner for registration of a criminal case.
An FIR on charges of attempt to murder,criminal intimidation and the Arms Act was registered against the petitioner on April 3. It has been alleged that the FIR was registered at the dictates of Kanda brothers.
