Army jawan dismissed, awarded 5 years in jail for sexually assaulting soldier’s minor daughter

The incident dates back to July 31, 2022, when the accused jawan molested the minor daughter of a fellow soldier, posted in the same unit, while she was playing with other children.

A General Court Martial (GCM) in Goa has held an Army jawan guilty of sexually assaulting the 12-year-old daughter of a fellow soldier and sentenced him to five years rigorous imprisonment and dismissal from service.

The court martial, which concluded on October 25 at a military station in Goa, held the jawan guilty of aggravated sexual assault on the child in two offences under Section 10 of the The Protection of Children from Sexual Offences Act, 2012 (POCSO Act)

The incident dates back to July 31, 2022, when the accused jawan molested the minor daughter of a fellow soldier, posted in the same unit, while she was playing with other children.

The accused had also taken the minor girl to a nearby ATM room and had molested her there. The girl’s siblings and other children had witnessed the incident. They were examined by the prosecution during the trial. The CCTV footage of the ATM room was also produced.

The court martial concluded that the prosecution had proved the case beyond reasonable doubt and held the jawan guilty of both the charges.

The court martial convened by General Officer Commanding (GOC) Dakshin Maharashtra and Gujarat Sub Area and had commenced the Proceedings from August 30. The presiding officer of the GCM was Colonel Prabhu and Judge Advocate was Capt Pooja Goyal. The prosecution counsel was Brigadier Janesh Khera (Retd).

Earlier this month, an Army Major was awarded a five year sentence and dishonourably discharged from service by a court martial for offences under the POCSO Act. He had been held guilty of sexual assault of the minor daughter of a domestic help.

In August this year, a jawan was sent to Patiala central jail after Army authorities confirmed his court martial sentence of 20 years imprisonment on five charges under the POCSO Act, which related to “committing a civil offence, that is to say aggravated penetrative sexual assault”.

Yet another Summary General Court Martial (SGCM) is taking place currently in Rajouri where another Army jawan is being tried on charges under the POCSO Act.
