The proposal comes six years after the Protection of Children from Sexual Offences (POCSO) Act was implemented in November 2012. Setting up of special courts was an essential mandate of the POCSO Act under Section 28 (1).
A bench of Justice Siddharth Mridul and Justice Sangita Dhingra Sehgal expressed displeasure over the way in which Delhi Police’s investigating officer probed a case involving the alleged illegal confinement and sexual assault of a five-year-old boy by a bus conductor.
The accused had submitted a false death certificate through his family member before a special court in Mumbai. The incident came to light after a policeman, who suspected the claim of death, went to the accused’s hometown to verify it.
