Amritsar trust case: Explanation sought

The Punjab and Haryana High Court,on Wednesday,asked the Punjab government to explain as to whether the charge sheet prepared by the Punjab Police in the infamous Amritsar Improvement Trust case is in accordance with the directions issued by the Supreme Court.

Justice K C Puri also asked the Punjab government to explain as to which part of the charge sheet prepared by the Punjab Police against Captain Amarinder Singh,former Chief Minister of Punjab,is independent of the special committee report of the Punjab Assembly.

The government has been asked to file an affidavit furnishing the said information by January 25. The directions were passed during the resumed hearing of a petition filed by Captain Amarinder Singh seeking quashing of the FIR registered against him by the Punjab Police.

In April 2010,the Supreme Court had held the expulsion of Captain Amarinder from the State Assembly as ‘constitutionally invalid’ and ordered restoration of his membership.

On September 28,2010 the High Court had asked Punjab to give details of the material collected by it independently of the recommendations made by the Vidhan Sabha Committee that had eventually led to the filing of an FIR against the former Chief Minister.

The counsel for Punjab had taken the stand that Supreme Court’s order did not imply that the investigation should come to a halt. On the other hand,senior lawyer APS Deol,counsel for Amarinder had averred that the very basis of the FIR had seized to exist in view of the Supreme Court verdict. Referring to the SC order,Deol had contended that all the actions emanating from the sub committee’s report were illegal.
