Naroda Gam case: Court issues warrant against CBI inspector

The special trial court hearing the 2002 Naroda Gam killings case on Thursday issued a bailable warrant against a CBI inspector after he failed to appear before it as a prosecution witness.

While issuing the warrant against N S Raju,the court said he had “intentionally disobeyed the order of the court and acted in a contemptuous manner”.

Raju has also been ordered to appear before the court on Friday morning and may face a non-bailable warrant if he fails to do so.

An inspector posted at CBI’s Mumbai office,Raju was part of the CBI’s team that probed the authenticity of a CD made during a sting operation carried out by a private news channel in which some of the accused in the riots cases are seen making claims about their role in the communal violence.

Earlier,the National Human Rights Commission had ordered CBI to check the authenticity of the CD,which is part of evidence before the trial court.

Raju was summoned by the court as a prosecution witness on Thursday. However,a few days ago,he moved an application seeking adjournment of his deposition to first week of July. The application was rejected by the court.

On Thursday,Raju failed to appear before the court or inform the court’s registrar about his inability to come.

“The omission on the part of the witness prima facie points out his intentional obstruction in the process of justice…” the court observed.

The court has asked The special public prosecutor in the case and one of the officers of the Supreme Court-appointed Special Investigation Team & Deputy Commissioner of Police of Ahmedabad City Detection of Crime Branch to immediately communicate the order to Raju by fax or phone or in any other manner.
