The Gujarat High Court on Tuesday dismissed a PIL urging the court to direct the PMO not to interfere with the investigation of the 2004 Ishrat Jahan fake encounter case and the CBIs Investigating Officer to arraign former Special Director of Central Intelligence Bureau (IB),Rajinder Kumar,as an accused in the case. The PIL was moved by Kantibhai Chavda from Ambawadi area of Ahmedabad. A division bench of HC,comprising Chief Justice Bhaskar Bhattacharya and Justice J B Pardiwala,dismissed the petition while holding that no court could direct an investigating agency to include a persons name as an accused in a chargesheet.
