The CBI had approached the Gujarat government for sanction on directions of the special court last October. It had sought sanction for prosecution under Section 197 of the Code of Criminal Procedure — under this section, prior sanction is required from a competent authority to prosecute a public servant.

In January, the CBI informed a special court, which is hearing the case, that they had sought the government's nod only after it was ordered to.

In his discharge plea, Vanzara also claimed that “the CBI actually wanted to target the then chief minister”. The special court has already discharged former Director General of Police P P Pandey in the encounter case.
