A day after actor Salman Khan’s lawyer told the court that fatal injuries caused to one of the five men in the 2002 hit-and-run case was due to rescue operations and not the car accident, the lawyer Saturday argued that the case was purely an accident and not an offence.

“The car was moving, there is sudden incident of tyre burst, the steering wheel stiffens and could not turn it to the right it to save the people and the accident takes place,” said Shrikant Shivade, Khan’s lawyer. He cited a statement of the RTO inspector, which said that the car was in a good condition in order to prove that the actor was “not negligent” in maintaining the car in good condition. Moreover, Shivade claimed, the conduct of the actor after the incident was that of an “innocent man” and not of one who is guilty of killing someone.

The actor had submitted that he was present at the spot for 15 minutes after the accident and he did not “run away”, as the prosecution alleged. Relying on the statement of the witness who came to the accident spot after he heard a loud noise, the defence claimed that Khan was “made to leave” the place due to mob fury. But according to the statement, the witness heard Khan saying “save me”. Shivade contended that Khan meant that the witness should save the injured and that it was merely a mis-communication. The court is likely to fix on April 20 the date of judgement in the case.
