Kazmi moves SC seeking transfer of case

A bench of Justices J Chelameswar and SK Singh adjourned the case for tomorrow and asked the Delhi Police to appear.

Syed Mohammad Kazmi, an accused in the Israeli diplomat attack case, moved the Supreme Court on Wednesday, seeking transfer of his case to another court. Kazmi alleged that the judge was biased against him and that he was apprehensive of not getting a fair trial.

A bench of Justices J Chelameswar and SK Singh adjourned the case for tomorrow and asked the Delhi Police to appear.

The bench, however, said that the High Court has supervisory power over trial courts and Kazmi can approach the High Court in case of any bias. The bench also said Kazmi could ask for a video recording of trial proceedings.

Kazmi approached the apex court, challenging High Court’s order which had refused to transfer the case. Kazmi’s counsel, Mehmood Pracha, contended that on May 3, the trial court only heard arguments on Kazmi’s application for discharge.

But the court said he had argued on framing of charges, which was wrong, Pracha said.
