After the August 5-6, 2019 amendment of Article 370 and bifurcation of J&K into two Union Territories, the central government redefined “permanent residents” of J&K as “domiciles”.

— The new definition said that anyone could be a domicile of the UT of J&K if:

(i) They had resided therein for 15 years; or Hence, 1 is not correct.

(ii) Studied there for seven years and appeared for their Class 10/12 examination in an educational institution in J&K; or Hence, 2 is correct.

(iii) Registered as migrants, and their children. Hence, 3 is correct.

(iv) It included the children of central government officials who had served in J&K for a total of ten years, including All India Service officers, Public Sector Undertakings, autonomous bodies, recognised research institutes, and central universities. Hence, 4 is not correct.

Therefore, option (b) is the correct answer.

2. (b)

FYI:

November 30 marks the 11th death anniversary of IK Gujaral, the 12th Prime Minister of India.

— Gujaral was in charge for less than a year, and his tenure received little individual attention from India’s leaders. He is, however, the only Prime Minister with a foreign policy approach named after him — the Gujral Doctrine.

— It was during his second tenure as External Affairs Minister (EAM) that Gujral delineated his approach towards India’s neighbours, which later came to be known as the Gujral Doctrine.

— This consisted of five basic principles, as outlined by Gujral at a speech in Chatham House in London in September 1996.

(1) India does not ask for reciprocity but gives all that it can in good faith and trust with the neighbours like Nepal, Bangladesh, Bhutan, Maldives and Sri Lanka.

(2) No South Asian country will allow its territory to be used against the interest of another country of the region.

(3) None will interfere in the internal affairs of another.

(4) All South Asian countries must respect each other’s territorial integrity and sovereignty.

(5) To settle all their disputes through peaceful bilateral negotiations.

— The Gujral Doctrine was based on the understanding that India’s size and population by default made it a major player in South East Asia, and its position and prestige could be better cemented by adopting a non-domineering attitude towards its smaller neighbours.

3. (a)

FYI:

— India’s Parliament has no fixed calendar of sittings. In 1955, a Lok Sabha committee had proposed a timetable for parliamentary sessions. It recommended that the Budget session of Parliament begin on February 1 and go on till May 7, and the Monsoon session start on July 15 and end on September 15.

— The government determines the date and duration of parliamentary sessions. The Cabinet Committee on Parliamentary Affairs takes this decision. It currently has ten Ministers, including those for Defence, Home, Finance, Agriculture, Tribal Affairs, Parliamentary Affairs, and Information and Broadcasting. Hence, statement 2 is not correct.

— The Constitution specifies that six months should not elapse between two parliamentary sessions. This provision is a colonial legacy. The framers of the Constitution borrowed it from the Government of India Act of 1935. Hence, statement 1 is correct.

— Dr. B R Ambedkar argued that the central parliament was convened solely to collect taxes, and that the once-a-year gathering allowed the government to evade examination by the legislature. The interval between sessions was decreased to six months by the Constituent Assembly.

Therefore, option (a) is the correct answer.

4. (c)

FYI:

Article 24 of the Constitution of India provides for prohibition of employment of children in factories, etc.

— No child below the age of fourteen years shall be employed to work in any factory or mine or engaged in any other hazardous employment.

5. (d)

FYI:

— Motions can be classified under the following categories, namely:—

(i) Substantive Motions;

(ii) Substitute Motions; and

(iii) Subsidiary Motions.

— A substantive motion is a self-contained, independent proposal submitted for the approval of the House and drafted in such a way as to be capable of expressing a decision of the House, e.g. all resolutions are substantive motions.

— Motions moved in substitution of the original motion for taking into consideration a policy or situation or statement or any other matter are called substitute motions.

Subsidiary Motions depend upon or relate to other motion or follow upon some proceedings in the House. They by themselves have no meaning and are not capable of stating the decision of the House without reference to the original motion or proceedings of the House.

— Subsidiary motions can be further divided into:—

(1) Ancillary Motions;

(2) Superseding Motions; and

(3) Amendments

Therefore, option (d) is the correct answer.
