The Supreme Court on Monday asked the government to reply to a petition alleging that illegal allocation of additional 2G spectrum to private telcos in excess of 6.2 MHz caused a loss of Rs 36,993 crore to the exchequer.
The petition says additional spectrum was given to private operators in 2008 beyond what was mandated in the licence without any recommendation,criteria,guidelines and without any fee. A Bench of Justices G S Singhvi and S J Mukhopadhyay issued notice to the Department of Telecommunications,Finance Ministry and TRAI.
The illegal distribution of scarce natural resource of spectrum to private operators without any spectrum fee and without there being any provision in the licence has caused a huge loss to the national exchequer to the tune of more than Rs 36,993 crore as recommended by CAG, said the petition.
The petition by Delhi-based lawyer Yakesh Anand claims that the issue of allotment of the excess spectrum,the resultant loss of public money and the liability of the accused,both on the side of the government and the private companies,have not been dealt with by either the SC or the Special Court conducting the trial.
Anand approached the SC after the Delhi HC dismissed his petition on December 21 while reasoning that this would lead to multiple litigation. But Anand,in his petition before the SC,says his cause of action is distinct from the pending ones in the SC and the trial court.
SC to decide Swamy plea against PMO today
The Supreme Court is set to finally pronounce on Tuesday its verdict on Janata Party chief Subramanian Swamys plea alleging delay on part of the PMO in replying to his request for sanction to prosecute then telecom minister A Raja in the 2G spectrum scam.
