Salem extradition order: CBI to move Portugal court

The CBI will move Portugal’s Constitutional Court to challenge the decision of its Supreme Court to terminate the extradition of Abu Salem to India.

Additional Solicitor General Haren Raval,appearing for the Delhi Police,told the Delhi High Court on Wednesday that the entire extradition process was in jeopardy so they have decided to resort to the last legal option: to approach the Portuguese Constitutional Court. Raval also sought an urgent hearing of the police’s petition seeking withdrawal of charges under the Maharashtra Control of Organised Crime Act (MCOCA) against Salem.

Justice Mukta Gupta,however,said she would have to refrain from passing an order as she had once appeared as a lawyer in a connected case against Salem. The case will be listed before another judge.

The Portugese SC had on January 14 upheld the order of the Court of Appeal in Lisbon terminating Salem’s extradition on the ground that India had breached deportation rules.
