Portugal court stays order on Salem

In what comes as a major relief for the Indian authorities,the Constitutional Court of Portugal stayed the order of its Supreme Court on violation of extradition agreement of underworld don Abu Salem by New Delhi by slapping new charges invoking death penalty

In what comes as a major relief for the Indian authorities,the Constitutional Court of Portugal stayed the order of its Supreme Court on violation of extradition agreement of underworld don Abu Salem by New Delhi by slapping new charges invoking death penalty.

The apex court in Portugal admitted the CBIs plea,which claimed that there was no violation in Rule of Speciality.

India in its plea had also mentioned the recent order of Supreme Court of India whereby it had stayed trial against Salem with regard to additional charges levelled against him.

On Monday,the Supreme Court refused to vacate its stay in view of the pendency of New Delhis plea with the Constitution Court of Portugal.

A bench headed by Justice P Sathasivam,which had stayed the proceedings in two cases including that in the 1993 Mumbai serial blasts,asked the CBI to file an affidavit within four weeks giving details on the proceedings in the Portuguese court.
