The Supreme Court SC Thursday denied Gujarat IPS officer P P Pandey protection from arrest by CBI while agreeing to hear his petition on August 12.
Pandey has been named an accused in the latest CBI charge sheet in the alleged fake encounter of Ishrat Jahan and three others in 2004.
We are not going to say anything now. We will hear you Monday, said a bench of Chief Justice P Sathasivam and Justice Ranjana Desai.
Pandey moved the apex court after the Gujarat High Court dismissed his anticipatory bail plea Wednesday.
The trial court, which had earlier denied him bail, issued a non-bailable warrant after the 1980-batch IPS officer failed to appear before it.
Pandey, declared a proclaimed absconder for not showing up before CBI and the court, had appeared before the Ahmedabad trial court on July 29 after the SC gave him two days to do so on July 26.
Pandey was Joint Commissioner of Police,Ahmedabad Crime Branch, when Ishrat,Javed Shaikh alias Pranesh Pillai,Amjadali Akbarali Rana and Zeeshan Johar were killed in an encounter on the outskirts of the city on June 15,2004.
