India on Wednesday said it intended to press for access to David Headley to question him and record his testimony and was examining the plea agreement between Headley and the US Attorney in the light of the provisions of the extradition treaty between Indian and the US.

David Coleman Headley and the US Attorney agreed on a plea bargain on March 18,2010. We are examining the legal implications of the agreement and,as I stated earlier,we intend to press our request for access to David Headley for questioning him and for recording his testimony, Union Home Minister P Chidambaram said. We are also examining the plea agreement in the light of the provisions of the extradition treaty between India and the US.

Asked whether he was not ruling out Headleys extradition,Chidambaram said,No I am not. I have with me the extradition treaty. I have with me the Mutual Legal Assistance Treaty. I also have before me the Plea Bargain agreement. So we are looking at the plea agreement in the light of the extradition treaty and the MLAT.

On when was the Indian government likely to approach the US Department of Justice for access to Headley,Chidambaram said,These are legal processes. Legal documents have to be got ready. And my experience as a lawyer tells me that legal documents have to be vetted carefully before they are presented to another authority. They are being vetted now. He also said that India will file a chargesheet against Headley at an appropriate time.

Asked about Indias stance towards co-accused Tahawwur Hussain Rana,the Home Minister said,Rana has pleaded not guilty. So,as I understand the American law,he will go through a trial. Only when the chargesheet is filed against Rana,we can contemplate what action we should take and what action we can take. At the moment,I do not have full information to come to any conclusion.
