A Backward Class student in one state cannot claim reservation under the same quota in another state unless his community is notified in that state too,the Madras HC has ruled.
Dismissing a petition by a medical seat aspirant from Rajasthan,who had migrated to Tamil Nadu 15 years ago,the HC said,The petitioners community did not find a place in the list of BC categories published in Tamil Nadu Under Article 15 of the Constitution.
Saying that only members of a backward community identified by the state government have the benefit of quota,the court said the petitioner did not carry the criteria of socio-economic backwardness identified by Tamil Nadu.
