After custody scare,John gets HC relief

However,his lawyers immediately moved the High Court and secured a stay on the order

After a stressful morning having to face the prospect of going to jail,actor John Abraham got relief after the Bombay High Court granted him bail Friday evening in a 2006 case of rash and negligent driving.

Sessions Judge N V Nhavkar upheld the Magistrate courts order and sent him to 15 days simple imprisonment for rash and negligent driving,causing injuries to two persons. However,his lawyers immediately moved the High Court and secured a stay on the order. On October 14,2010,the Bandra Metropolitan Magistrates court had sentenced him to 15 days imprisonment.

In an eight-hour-long drama that unfolded before the Sessions court on Friday,Abraham appeared visibly flustered at the thought of having to spend time behind bars,and kept seeking updates from his lawyers.

There is no need to interfere with the trial courts order, the Sessions Court observed. When Abrahams counsel Harshad Ponda moved an application seeking suspension of the order and simultaneously moved a bail application,both pleas were rejected by the court. It is an appellate court. It does not have a jurisdiction, the Sessions Court stated.

In the High Court,responding to the courts query pertaining to the denial of bail to the 37-year-old actor,Ponda said,He is a celebrity. The idea would be to publicise the case. Someone may even want to spoil his career.

Considering the fact that the victims suffered only simple injuries and the accused has been on bail throughout,he Abraham may be released on bail, Justice R C Chavan said. The actor has been asked to deposit Rs 20,000 for securing bail.
