A local court on Monday afternoon restrained newspapers and TV channels from publishing or telecasting contents of CDs of the narco tests conducted on the three accused in the sister Abhaya murder case.
Ernakulam Chief Judicial Magistrate K A Baby passed the order after being informed that some Malayalam TV channels were telecasting portions of the CDs of the narco analysis tests of the accused Father Thomas Kottoor,Jose Poothrikayil and Sister Sephy conducted earlier this year.
The footage aired by TV channels showed one of the accused admitting to the murder. He said the nun was killed by a big hammer he also mentioned axe.
Sister Abhaya was found dead in the well at St Pius Convent in Kottayam in 1992. Police said it was a case of suicide and closed the case. The investigation was later taken over by the CBI which filed three closure reports.
The Kerala High Court,however,refused to accept the reports and asked the CBIs Kochi unit to take over the probe from the agency8217;s Delhi unit. It arrested the trio for murder in November last year and filed the charge sheet in the court of the CJM court on July 17.
The accused were later subjected to narco analysis tests and CD8217;s of the tests were submitted to the High Court. A bench of Justice V Ramkumar and Justice Hema,however,found the CDs were tampered with. The CBI admitted the CDs were edited at several places and put the blame for tampering on the forensic lab but soon changed its stand,saying 8220;editing of the CD8217;s was natural8221;.
