NEW DELHI, MAY 17: The Delhi High Court today asked the Centre and Delhi Government to spell out their stand on a petition seeking CBI probe into model Jessica Lal murder case.

A division bench comprising Justice Anil Dev Singh and Justice Mukul Mudgal issued the notices to Ministry of Home Affairs (MHA) and chief secretary to Delhi Government to file replies by May 21.

The notices were issued on a criminal writ petition by a non-governmental organisation (NGO) – Bhrashtachar Virodhi Morcha (BVM) which alleged that Delhi police was not able to investigate the matter properly due to influence of higher ups.

“Delhi police investigation uptil now is very poor and is giving an impression to the general public that the law is very poor and weak for big persons,” the plea moved by advocates Mohammed Sajjid and Arun Kaushal said.

The reports published in the media about the “conduct of police officers clearly shows that a fair investigation is not possible.” The petition said.

It said the policeofficers probing the case were not in a position to take a “bold investigation for reason that officers of higher rank are involved.”

The police, apart from former joint commissioner of police YS Dadwal, was not yet able to release the names of three other senior officers who were allegedly present at socialite Bina Ramani’s “illegal” Tamarind Court restaurant on the day Jessica Lal was shot dead.

The petitioner said CBI investigation into the case also became necessary in view of Bina Ramani and her family members’ foreign citizenship.

The petition said the present case was not only a “mystery” of the murder of a model but could “definitely disclose a dangerous nexus between the economic mafias causing irreparable loss to the nation by misusing powers and positions of high officials to achieve their ulterior motives”.

“Because the names of top government officials (those present at the party on April 30) are yet to be revealed, the powerful officers are trying to suppress, humiliate and shutdown the subordinate officers investigating the case,” the petitioner alleged.

Meanwhile, anticipatory bail petition of Jantantarik Bahujan Samaj Party (JBSP) leader DP Yadav’s son Vikas Yadav was today dismissed as “withdrawn” by a sessions court.

A city court today dismissed as withdrawn the anticipatory bail plea of Vikas Yadav who is on the run since the murder of ramp model Jessica Lal in an illegal bar in south Delhi on April 30.

Additional sessions judge PK Bhasin allowed JK Bharati, counsel for Yadav, son of Rajya Sabha member DP Yadav, to withdraw the petition when he said he would approach the court after the Delhi high court decides on a public interest litigation seeking a CBI inquiry into the murder case.

Bharati submitted that he also wanted to make some amendments in the petition after the high court decides whether the matter should be probed by the CBI.

The Bharastachar Virodhi Manch hasfiled the PIL in the HC and the matter is listed before a division bench comprising acting Chief Justice Devinder Gupta and Justice KS Gupta today.

Police has been trying to trace Vikas, an alleged accomplice of Manu Sharma, for allegedly helping the prime accused, causing destruction of evidence and harbouring him.
