
MUMBAI, MARCH 16: The Ulhasnagar Municipal Corporation UMC has disqualified Ulhasnagar People8217;s Party UPP corporator Manohar Jaiswani from the membership of the corporation citing his conviction in 1997 in a case of assault on a traffic cop. A letter, signed by Commissioner A D Kale, issued to Jaiswani today said: 8220;You cease to hold office from the date of the conviction during the term of office as per Section 11 of the Bombay Provincial Municipal Act.8221;
The disqualification, the first in UMC, has created panic among corporators, many of whom have either been convicted or have cases pending against them in courts. 8220;Frantic calls are being made to lawyers to find out whether the same can be done in their cases too,8221; said a Congress party insider.
The letter issued to Jaiswani points out that the corporator was convicted by the court of Jt Civic Judge junior division M A Ansari in a criminal case no 361/90 on December 31, 1997. 8220;Your conviction is punishable under Sec 186 amp; 189 of the IPC andSec 120 of the Bombay Police Act,8221; it says and adds that the corporator8217;s act of beating up a cop 8220;involved moral turpitude and the sentence imposed on you in the said judgement for three months is a disqualification.8221;
The letter also has a suggestion for him: 8220;If you have any doubt as to whether you can be disqualified you may refer the same to the judge.8221; While UPP party leader Jyoti Kalani could not be contacted, it was learnt that Jaiswani had moved the Kalyan court against his disqualification and that his case was admitted his case. 8220;I will fight against this injustice,8221; Jaiswani said.
