SC upholds cop’s termination over ‘sexual lust’

The Supreme Court has upheld the termination of a constable for barging into a woman’s house in a drunken state for sexual favours, terming the incident as unfortunate and disgraceful.

A Bench of Justices A K Mathur and H S Bedi also slammed the Andhra Pradesh High Court for ordering reinstatement of the delinquent constable K Ravinder Rao with 50 per cent back wages.

“It is unfortunate that a police constable who is supposed to safeguard the public makes such a unreasonable demand on going to someone’s house for satisfying his sexual lust,” the apex court observed, while allowing an appeal filed by the state government against the high court order.

Rao, a constable with Uppal Police Station in Hyderabad on May 9, 1985 in a drunken state barged into the house of a K Susheela and demanded that she supply him girls for satisfying his lust.

On the basis of an inquiry, the constable was removed from the service on October 1, 1993 by the state government which was upheld by the A P Administrative Tribunal.

However, the state High Court set aside the termination on the ground that the punishment was disproportionate to the offence and ordered his reinstatement with 50 per cent back wages for the 12 years period during which he was under termination.
