NEW DELHI, Aug 18: A three-judge bench comprising Justice S B Majmudar, Justice M Srinivasan and Justice U C Banerjee said the commission was not justified in restraining Colgate from using "suraksha chakra" as it has given no reasons for the same.

Allowing the appeal filed by Colgate against the MRTPC injunction, the bench said the commission also did not take into account the submission of the company that they had been using the punch line for last 13 years.

MRTPC had restrained Colgate last year on a complaint filed by Hindustan Lever Ltd (HLL) that the “suraksha chakra” claim of its rival was misleading the consumers amounting to unfair trade practices.

Colgate and HLL were locked in litigations accusing each other of unfair trade practices concerning advertisements to promote each others toothpastes.

Colgate had also filed a complaint before the MRTPC against HLL for claiming that its Pepsodent brand was 102 per cent better than any other toothpaste brands.
