
PUNE, Nov 12: Pandit Sapkale, main accused in the Jalgaon sex scandal, was released from Yerawada Central Jail this afternoon and subsequently taken into custody by the crime branch, Pune.
Later, he was taken to Jalgaon in a police van. His brother Bhagwan Sapkale, who had come to the city when Sapkale was shifted yesterday from Nagpur prison to Yerawada, also left for Jalgaon today.
After being released from the jail, Sapkale was brought to the Police Commissioner8217;s office and told that the Jalgaon superintendent of police has sought his presence before him due to increasing public opinion against him, according to sources.
Shrikant Shivde, advocate for the accused, came out strongly against the detention. 8220;Neither the jail authorities nor the police had a warrant from any court as per the information available. It is unconstitutional to detain a person without giving him a reason for the detention. The police have no authority to detain him even for a minute,8221; he told The Indian Express. Sapkale was acquitted in 10 cases, but he still has two cases pending against him at Jalgaon. One of threatening his landlord and other is possession of obscene cassettes. 8220;Both these cases do not fall under the sex scandal as per the findings of judge Mridula Bhatkar. Besides, he is already under bail,8221; said Shivde.
In July-August Sapkale was detained under the National Securities Act NSA. 8220;Sapkale has been in prison since July 1994. He has already served detention under NSA. He cannot be detained twice on the same grounds,8221; said Shivde.
