CHANDIGARH, April 6: Upholding the order of UT District Forum-I, the Consumer Disputes Redressal Commission has directed Mahajan and Company, Chandigarh branch, and Haryana Coir Product Limited to pay Rs 3,200 for supplying defective mattresses to the complainant.

The commission further directed the company to pay interest at the rate of 18 per cent per annum in case they fail to refund the amount within two months.

Dismissing the appeal of complainant Jagjit Singh wherein he asked for a refund of Rs 3,625 paid for the purchase of the mattress, the commission bench comprising president J. B. Garg and members P. K. Vasudeva and D. J. Dhatt, stated that the order of the District Forum required no modification.

In his appeal, the complainant stated that he had purchased a pair of Coirlene Royal gold mattresses and a pair of pillows from the said company for a sum of Rs 3,900. The period of warranty was 365 days.

It was alleged that the mattresses lost their shape and strength within a period of three months. When approached, the dealer delivered a new set of mattresses which also started sagging and losing shape.

The appellant stated that once the District Forum was satisfied that the mattresses supplied to the consumer were not according to the promise, he was entitled to total refund.

Observing that the consumer had utilised the original set as well as the set later delivered, the commission stated that there was no need to modify the order of the Forum.
