CHENNAI, Feb 10: The first Bench of the Madras High Court has declined to pass any orders on the public interest writ petition challenging the constitutional validity of the February 5 notification of the Central Government, which re-allocated the corruption cases pending before special courts to sessions judges in Chennai.

8220;In our considered view, it is not desirable or appropriate for us to go into the question as to whether the Central Government has jurisdiction to issue the notification and to consider its effect, pending a decision by the Supreme Court and pass any order or issue notice to the other side,8221; the Bench comprising acting Chief Justice NK Jain and Justice V Kanakaraj observed today.

The matter relating to establishment of the three special courts under the PC Act by a notification of the State Government and ancillary issues are now pending before the SC. Admittedly, the matter is subjudice and seized of by the Supreme Court. Hence, 8220;We do not consider it proper to comment at thisstage,8221; the Bench said and disposed of the petition accordingly.
