CHANDIGARH, May 13: UT Civil Judge Junior Division A.K. Bishnoi today issued notice for May 19 to Commissioner-cum-Secretary, Social Welfare Department, Haryana, and Dheera Khandelwal, Managing Director, Haryana Women Development Corporation HWDC, on a civil suit seeking the court to set aside the order dated July 17, 1998 pertaining to transfer of plaintiff from Ambala to Jind.

Plaintiff Rohita Baloo, HWDC district manager, further sought the court to declare as quot;illegal, arbitrary and malafidequot; the order of the Corporation, dated March 30, 1999, whereby she had been rejected casual leave.

In her plaint, she stated that she had been working at Jind, but on request, was transferred to Ambala vide the order dated April 29, 1998, and also given additional charge of Panchkula. It was stated that her work at Ambala was satisfactory and no explanation was ever called. But in July she fell ill due to termination of pregnancy and had proceeded on leave from July 20. While on leave, she learnt that vide an order dated July 17, 1998, she had been transferred back to Jind. The plaintiff added that on October 6 she applied for leave without pay but her application was rejected on November 16.

Nigerian sentenced for two months
A nigerian national, Kenneth Chikezie was today convicted by UT Judicial Magistrate Ist Class Tejwinder Singh for overstaying in India without getting the residential permit extended. Holding the accused guilty of offence under Section 14 of the Foreigners8217; Act, the Magistrate sentenced him to undergo simple imprisonment for two months and pay a fine of Rs 500. In case of default of payment of fine, the accused was directed to undergo further imprisonment for a period of seven days.

The case had been registered on the complaint of Sub-Inspector Jagmohan, who stated that as per the passport, the period of stay of the accused in India was valid only up to March 5, 1996 and that the accused did not get his stay extended. The FIR was registered on August 14, following which the accused was arrested.

Bail for 2 accused of dacoity bid
UT Additional Sessions Judge G.S. Sandhu granted bail to Jasbir Singh and Phinder, held for attempting dacoity. They were ordered to be released after paying bail bonds of Rs 25,000 each, along with a surety in like amount.

The two have been in custody since November 23, 1998, when they were booked under Sections 400, 402 IPC. They were released on bail after the Sub-Inspector placed on record a written reply stating that there was no criminal record against the accused except one case under the NDPS Act.

The prosecution submitted that on the said date, the police were tipped off that some men intended to commit dacoity in Sector 15 and that they were lurking in Sector 25 cremation grounds. The police raided the area and arrested the accused and recovered weapons from their possession. Among those arrested were Om Parkash, Brij Mohan, Harvinder, along with the two applicants.

Two convicted
Two city residents were convicted for creating public nuisance under the influence of liquor and sentenced to pay a fine of Rs 50 each. Holding the alleged accused guilty under Sections 34/5/61 of the Police Act, UT Judicial Magistrate Ist Class A.K. Bishnoi directed the two to undergo seven-days simple imprisonment in case of default of payment of fine.

Accused Gurdeep Singh was booked on May 7, after he was arrested from Sector 44. Other accused, Nazamuddin, a Ghazipur resident, was also arrested on the same charge on May 8.
