
NEW DELHI, May 1: A city court today rejected five bail applications of Independent MLA from Jehangirpuri, Jitendra Kumar alias Kalu Bhaiyya. The five cheating cases relate to the sale of government land. The prosecution had opposed the bail applications submitting that 8220;8230; when the land in question was sold it was gram sabha land and the amount received by the accused was the sale proceed of the land.8221;
Additional Sessions Judge Y.S. Jonwal said: 8220;Considering the facts and circumstances of the case I am not inclined to grant bail. The bail application is rejected.8221;
On December 6, 1994, complainant Ram Pal Tyagi alleged that Kalu Bhaiyya had sold him a 200-square-yard plot of land in Samaipur Badli for Rs 40,000. He had built a room and boundary wall on the plot, which were demolished by the Delhi Development Authority DDA in December 1993, as the land actually belonged to the gram sabha.
Charges were framed against Kalu Bhaiyya and five others Kamal, Sarfaraz, Ram Avtaar, Sukhdev Singh and Kailash Chand under Sections 420 cheating, 468 forgery for purpose of cheating, 471 using as genuine a forged document and 506 criminal intimidation of the Indian Penal Code.
Kalu Bhaiyya was arrested by the Special Staff on April 2 in connection with four of the cases. Metropolitan Magistrate S.S. Handa rejected his bail application and remanded him to judicial custody till April 16. It was at this time that Kalu Bhaiyya sent his resignation to the Speaker of the Delhi Assembly. The letter was forwarded to the court of Chief Metropolitan Magistrate Prem Kumar.
