The plaintiff S I Sanklecha lost the elections by a few votes. He realised that Lunkad had not paid the annual subscription fees of the chamber for a number of years. The plaintiff wrote to the secretary general of MCCI urging him to set the election right stating that Lunkad was not eligible to contest the elections.
Meanwhile, Lunkad paid up Rs. 1.25 lakh as fees and the chamber did take any action. The petitioner then filed a civil suit. The matter has been fixed for hearing on February 8.
