Justice Hans Raj Khanna, 95, a former judge of the Supreme Court, known for his fearless stance, passed away while in sleep at his residence here on Monday evening. He will be cremated on Tuesday, family members said.

Justice Khanna was appointed a judge of the apex court in September 1971. He was elevated from the Delhi High Court, where he had served for three years from 1969.

Senior advocate K K Venugopal fondly recalled how he had upheld the pride and prestige of the Supreme Court when other judges, who sat in the landmark ADM Jabalpur case, had 8220;failed the nation.8221; In recognition of Justice Khanna8217;s contribution, the Supreme Court had unveiled his portrait in its court hall, Venugopal said.

Senior advocates and legal luminaries remembered how he did not care for not being promoted as the Chief Justice during Emergency as he dissented in the the ADM Jabalpur case. 8220;He did not agree with the majority that no remedy was available to challenge an illegal detention order,8221; said former Attorney General Soli Sorabjee, adding: 8220;His passing away will leave a deep void in the array of courageous judges8221;.
