
NEW DELHI, July 21: Urban Affairs Minister and noted lawyer Ram Jethmalani once again defended himself, this time in the Rajya Sabha, for his statement questioning the appointment of judges. The proceedings of the Upper House were enlivened by a virtual courtroom drama with a duel between two legal personalities: Jethmalani and Kapil Sibal Congress.
Far from denying his controversial statement that the recommendations of the Chief Justice of India were questionable, Jethmalani stuck to his stand. In a refreshing change, he averred that he had not been misquoted by the media. 8220;I respect the judiciary. I was only pointing out the loopholes in the system,8221; he said. 8220;I merely said that as the stipulated consultative process had not been followed the recommendations were questionable and has led to a deadlock.8221;
As Sibal, Pranab Mukherjee and several Left MPs tried to pin Jethmalani down on his statement, he demonstrated his prowess as a lawyer, holding forth for nearly one hour punctuated by innumerableinterruptions as points of order were raised and Opposition MPs objected to his 8220;long-winded, irrelevant and repetitive8221; explanation.
The issue was raised through a special mention by Congress member Vyalar Ravi, Sanjay Nirupam Shiv Sena and Sanatan Bisi JD.
In view of the deadlock, Jethmalani said he favoured setting up of a National Judicial Commission a point included in the government8217;s National Agenda to deal with such situations. He also clarified that he had made the remarks in his personal capacity. Every member, including a minister, was free to express his personal views unless a collective decision had been taken by the Cabinet, he added.
