The Supreme Court on Monday allowed the RG Kar Medical College and Hospital rape and murder victim’s parents to pursue in the Calcutta High Court their petition seeking further investigation into the incident.
A bench of Chief Justice of India (CJI) Sanjiv Khanna and Justices Sanjay Kumar and Joymalya Bagchi in its order said, “We dispose of the application observing the applicant is at liberty to pursue the writ petition before the HC. We however do not express any opinion on what order the HC may pass.”
Meanwhile, the victim’s family and colleagues welcomed the Supreme Court’s order, underlining that it is a step forward in their pursuit of justice.
Appearing for the family, Senior Advocate Karuna Nundy referred to an application they filed in the top court which had initiated suo motu proceedings in the matter and was monitoring the CBI probe. The application urged the SC to clarify that the suo motu proceedings will not prevent the parents from approaching the High Court for further investigation against Ghosh and Abhijit Mondal, officer in-charge of the Tala police station, for allegedly tampering with evidence in the case.
They had also sought permission to proceed with a writ petition filed by them in the HC before the trial court convicted Sanjoy Roy, the main accused in the case. The pending petition challenged the bail granted by the Sealdah Additional Chief Judicial Magistrate Court to Ghosh and Mondal on December 13, 2024, and sought further probe into the alleged cover-up of the crime.
Nundy urged the bench, “The plea is that as a forum of convenience if a single judge may be permitted to continue with monitoring further investigation.”
Disposing of the application, CJI Khanna said, “We are not going to say anything. We are simply going to permit the single judge to continue with the writ petition, not making any comments either way, not saying that the investigation should continue or not continue…we will simply allow the application that the writ petition filed by you may be heard.”
Speaking to The Indian Express from New Delhi over phone, the victim’s mother said, “It is a step forward in our fight for justice. There are many people involved in the crime and efforts were made to tamper with the evidence. For this reason, a probe is required…”
Aniket Mahato, a key figure in the junior doctors’ protest after the August 9 incident last year, said, “It is a positive step. We all want to know how and why such a crime took place in such a busy hospital. If the High Court is able to play a positive role, it will be a great thing for us.”
