A court today directed Tihar Jail Superintendent to appear before it tomorrow to reply to an allegation by one of the Delhi gangrape accused that he was badly beaten up by prison inmates last night.
Accused Vinay Sharma,who came into the court of Additional Sessions Judge Yogesh Khanna with a fractured hand,pleaded that he should not be sent back to Tihar Jail.
“Mujhe yahi marwa do par Tihar jail mat bhejo,waha boht darr lagta hai. Mey yahi se kud jauga par Tihar nahi jauga (You can get me killed here but don’t send me to Tihar Jail,I feel afraid there. I will jump from here but will not go to Tihar),Vinay’s counsel A P Singh told the court on behalf of his client.
Taking note of the condition of the accused,the court directed that further “security and safety of all the four accused should be ensured by the jail officials”.
It sought reply from the superintendent of Jail number 7 and directed him to personally appear before it tomorrow.
“In view of the above,it is directed that medical examination of accused including X-ray should be done and brought to the court tomorrow also,” the court said.
The judge,who was concerned about the safety of the accused,mentioned in his order that earlier also he had directed the jail authorities to ensure security and safety of the accused after the main accused Ram Singh had allegedly committed suicide in his cell in the jail on March 11.
The court while referring to the medical report of G B Pant Hospital here observed that Vinay’s elbow was fractured “due to a fall”.
On seeing Vinay’s condition,Special Public Prosecutor Dayan Krishnan said,”I am also extremely disturbed to see the accused person coming to the court in this condition”.
Initially,five accused in the case were facing trial for allegedly gang-raping and assaulting a 23-year-old girl in a moving bus on the night of December 16,2012.
With the proceedings against the main accused Ram Singh having abated after his death on March 11,the remaining four adults accused Mukesh,Vinay,Akshay and Pawan Gupta are facing trial in the case for rape and murder of the girl.
The sixth accused in the case is a juvenile who is facing proceedings before the Juvenile Justice Board here.
Krishnan requested the court that the jail superintendent be summoned to explain the allegation levelled by the accused.
Vinay,who was having injury marks all over his body,informed the court through his counsel A P Singh that his hand was broken by the jail inmates to stop him from appearing in a written test for Indian Air Force.
The court has also sought reply from the jail authorities on the plea of Vinay and co-accused Akshay Thakur as to why they should not be shifted from Tihar jail to Rohini Jail.
Seeking transfer of accused Vinay and Akshay Singh from Tihar Jail to Rohini Jail,their advocate also sought court’s direction to register an FIR against the real culprit.
Yesterday,accused Akshay had alleged in the court that he was receiving life threats in the jail from a police constable who was continuously abusing him.
Meanwhile,the police today opposed Vinay’s plea seeking interim bail for two days to sit for his Indian Air Force clerical examination scheduled on April 7.
During the day’s proceedings,the lawyers also protested inside the court room that they will not proceed with the case if the court does not call for a report from the jail today itself.
Advocate Singh,during the protest,also said that he would not allow his client to go back to jail.
“If anything happens to the accused (Akshay and Vinay) tomorrow,who is going to take the responsibility,” Singh said.
Meanwhile,advocate M L Sharma,called his client accused Mukesh near the judge’s podium and he also alleged that six policemen had beaten Akshay and Vinay.
“I was also beaten up,” Mukesh said. To which the trio’s counsel said that a home secretary level official of state and Centre should be called and reply be filed on their behalf.
They also said that the accused should not be sent in Delhi Police custody to Tihar Jail because they will be killed.
This was,however,opposed by the prosecutor saying Delhi Police has no access to the jail and the jail security is under the control of other agency.
One of the co-accused informed his lawyer that Vinay was unwell since yesterday as he was feeling sick. He was taken to jail dispensary yesterday after he was taken back to Tihar Jail from the court.
When he returned from the dispensary at around 11 pm yesterday,they noticed that his arm was broken,the co-accused told the court.
Meanwhile,Sharma claimed that Mukesh is suffering from chest pain because was “poisoned”.
During the proceedings,the court recorded the statement of the Delhi Police official who had registered the FIR in the case.
