In a boost to the RTI mechanism,the Delhi High Court has blanked out a rule that only “affected” persons can apply for information under the transparency law.
The Delhi High Court Registry has a issued notification amending clause 4 (IV),which allowed only “affected persons” and no third parties unless the latter explained why they sought the information.
The court has further tightened the deadline for its public information officers by bringing down the number of days to provide a response to the RTI application from 15 to 5 days.
Thirdly,the court can no longer refuse to comply to an RTI request on the ground that the information was “not in public domain”. This implies that the high court cannot refuse to provide information by maintaining that the it lies with some other public authority.
