(Representative image: File)The Chhattisgarh High Court recently upheld the divorce decree granted by a family court to a man on the grounds of cruelty after his wife allegedly compelled him to abandon his parents and called him a “paaltu chuha (pet rat)”.
The wife, who is 34 years old, had approached the Chhattisgarh High Court appealing against the family court judgment dated August 23, 2019, granting divorce to her husband.
The couple got married in 2009 and had a son in 2010. The husband alleged that his wife constantly instigated him against his parents and insisted that they live separately from her in-laws.
When he refused to separate from his parents, it was alleged that his wife became aggressive and physically assaulted him.
Additionally, it was claimed that she used derogatory language against the husband, calling him a “pet rat” for obeying his parents.
He said his wife left for her parental home on August 24, 2010, for the festival of Teeja and never returned. He claimed that he was not informed about nor invited to any ceremonies related to their newborn son.
The wife, however, denied the allegations and said she was never accepted by her in-laws as a family member. It was further alleged that her husband neglected her emotionally and financially, used abusive language, and was often intoxicated.
She also said her attempts to restore physical relations were met with refusal and that the man showed no interest in resuming cohabitation as he was determined to obtain a divorce.
After listening to both sides, the two-judge Bench of the Chhattisgarh High Court, comprising Justices Rajani Dubey and Amitendra Kishore Prasad, upheld the family court’s order and dismissed the wife’s appeal.
The court, however, asked the man to pay Rs 5 lakh as permanent alimony within six months. Apart from this, he will have to pay her a maintenance of Rs 1,000 and another Rs 6,000 for their son per month. The court noted that she earns Rs 46,941 per month and he earns Rs 35,000 per month.
