NEET UG 2024 SC Hearing: The Supreme Court on July 23 dismissed the plea demanding cancellation and re-test of NEET UG 2024 exam. CJI said there was no data on record to indicate a systemic leak of question paper and other malpractices. Education Minister, meanwhile, has asked NTA to issue a revised merit list, a move that will affect 44 exam toppers who may see their ranks slip by at least 88 position.

The Central Bureau of Investigation Tuesday confirmed before the Supreme Court that the paper leak in the NEET-UG case had occurred in Hazaribagh centre. An officer from the CBI told that some gadgets of the involved gang were burnt, and a few others were recovered yesterday, which will now be investigated.

Further, the CJI on Tuesday said that they have received the IIT Delhi report led by director Prof Banerjee and it says option 4 is the correct answer. He further added that the Court accepts IIT Delhi report and accordingly NTA shall re-tally the NEET UG result on the basis that option 4.

Another plea from Madhya Pradesh demanded exemption from re-test, if SC orders, for tribals and rural students.

Senior advocate Hooda told the top court that the paper leak took place through WhatsApp so it was impossible that it was confined only to Patna in Bihar. “Solvers were taken from Rajasthan. Dissemination was through WhatsApp. It is not possible that the leak is confined to Patna,” he said. He further said that if the apex court is “not considering re-NEET, at least qualified people should be asked to re-take the exam, which will be about 13 lakh people.”

The bench comprising Chief Justice of India, DY Chandrachud, Justices JB Pardiwala and Manoj Misra is hearing nearly 40 pleas related to the alleged irregularities on the National Eligibility cum Entrance Test, Undergraduate (NEET UG) 2024.

NTA NEET UG 2024 Supreme Court Hearing Live: 'Oppn tried to create anarchy using NEET issue', says Pradhan

The Union Education Minister Dharmendra Pradhan on Tuesday accused the opposition of trying to create "anarchy" and "civil unrest" using the NEET-UG issue and said with the Supreme Court verdict related to the controversy-ridden exam, "truth has prevailed".

The opposition should apologise to students and their parents for "misleading" them, Pradhan said as he announced that the final results for the medical entrance 2024 NEET-UG exam will be declared within two days according to the observations made by the Supreme Court.

The court on Tuesday dismissed the pleas seeking cancellation and re-test of the 2024 NEET-UG, holding that there was no evidence on record to conclude that it was "vitiated" on account of "systemic breach" of its sanctity.

The interim verdict, to be followed by a detailed and reasoned order, came as a shot in the arm for the embattled BJP-led NDA government and the National Testing Agency (NTA), which were facing strong criticism and protests, on streets and in Parliament, over alleged large-scale malpractices like question paper leak, fraud and impersonation in the prestigious test held on May 5.

The revised final results of the exam will be announced taking into account marks of a physics question, which the NTA said had two correct answers. The revised result likely to reduce the number of toppers as 44 out of 61 toppers had shared the top rank because of this.

NTA NEET UG 2024 Supreme Court Hearing Live: Mixed reactions from students on revised result

The candidates immediately impacted by the decision offer a mixed reaction on the same. Since a leak has been admitted by both NTA, and the Top Court, some students raise concerns of improper filtration of malpractice. While the court stated clearly that the CBI investigation will continue and action will be taken corresponding to any new findings, students fear that any malpractice that has potentially gone undetected thus far is still a compromise of the fairness of their result. “We expected filtration if not a retest” says an aspirant when asked on her views on judgement.
While the nervousness around further revelation of malpractice pertains, students are also worried about the impact of the markings of the ambiguous question on their result. A student who obtained 608 marks in the previously announced results and wishes to remain unnamed told The Indian Express “I will lose 5 marks, which means a total of 603. Five marks is a lot of ranks.”
For an exam that forms the basis of admission into every medical college across the country, a change of every one mark, entails a change of multiple ranks.
Some students on the other hand are relieved over the said verdict. Suhani, an aspirant who scored 550 marks, mentioned that in their preparation of two or more years, students ‘build a certain momentum’. “To expect us to give the exam again after a break of two months would be unfair”. She also told us that many students are unsure of the exam being free of malpractice provided the cases that have come forth in states like Patna. However, students like Suhani who are satisfied with their result are relieved that they would not have to reappear for the exam and risk their present score to another.
With regard to the marking of the ambiguous question, she said “NTA took too long to decide”. Had the instructions on the right option been clearer, students would’ve been mentally prepared amidst the chaos and uncertainty around the exam.
Most students however are relieved that at least the admission and counselling for medical colleges would begin shortly, without delaying the academic calendar any further.

Keeping in line with the directions of the Supreme Court, the National Testing Agency (NTA) is expected to issue a revised merit list for the NEET undergraduate examination, a move that will affect 44 exam toppers who may see their ranks slip by at least 88 positions, if not more, The Indian Express has learned.

In the results announced on June 4, there were a record 67 candidates who had scored a perfect 720 marks and tied for the top spot. Of these, six topped due to being compensated with extra marks for time lost during the examination because of mistakes made by invigilators. Apart from that, as many as 44 made it to the top because they got an answer to a basic physics question wrong and received “grace marks” for it.

In a hearing before the SC, the CBI said that the leak occurred at Hazaribagh’s Oasis School on May 5 — the day of the exam. It also confirmed that the paper was also solved in the same school.

“We have CCTV footage to show that the main accused Pankaj Kumar alias Aditya has accessed the strongroom in the Oasis School. The front door was locked in front of everybody and the key was with the Centre Superintendent. However, the inside bolt of the rear door was kept deliberately open by the Centre Superintendent as well as the city coordinator as part of the conspiracy to allow somebody to enter. Accused Pankaj Kumar enters the campus at 7.12 am and sits in the staff room adjacent to the strong room. So, at 7.53 am the front door of the string room was locked… from the rear door at 8.02 am, this man entered from behind and left at 9.23 am,” the CBI said.

Through this, the CBI, Centre and NTA have tried to prove that the paper leak was not widespread and limited to a couple of centres.

'Now we know that there was a leak very much and that it originated in Hazaribagh and was transmitted to Patna,' says CJI.

NEET 2024 Supreme Court Hearing Updates: In July 22 hearing, the counsel said there's an organised gang, which has a prior experience to leak the paper; it is their business model. They refer to the In Tanwi Sarwal case where the Court ordered re-test for AIPMT for about 6 lakh students, when at least 44 were found to have taken unfair means. "Even if, one undeserving candidate, a beneficiary of such illegal machination, though undetected is retained in the process it would be in denial of, the claim of more deserving candidates"- another counsel quoted from the Tanvi Sarwal case.

Meanwhile, the counsel informs 44 students got full marks because of the grace marks given for this ambiguous question to which CJI raises doubt. He said: "The instructions are that go by the latest NCERT edition. Option 4 is the correct answer as per the latest NCERT edition. Then those who answered option 2 cannot be given full marks. There, I think they may have a point."

The counsel has alleged irregularity in the IIT Madras report submitted at the apex court. "One Hardayal School from Bahadurgarh has a special story...there were 6 people...What happened in Bahadurgarh is glaring. NTA never disclosed that the question paper taken from Canara Bank was distributed. There was no delay. The principal of school is on record that they collected papers from SBI and Canara Bank," said Hooda.

However, the CJI told the petitioners: "You have to show us that the leak was so systemic and affected the entire examination so as to warrant the cancellation of the entire exam. The re-examination has to be on concrete footing that the sanctity of entire test was affected."

The top court judges also said that since the CBI probe is on, if the agency's report is revealed, it will affect the investigation as people will become wise.

Meanwhile, CBI has detained four MBBS students from AIIMS Patna in connection with the alleged leak of the NEET UG. “The CBI had shared phone numbers and photographs of some of our students. The agency then took the MBBS students under detention,” said Gopal Krishna Pal, executive director of AIIMS Patna. He said the students were cooperating with the CBI.

While hearing on marks inflation and alleged paper leak, the top court has asked the NTA to inform that out of the students who changed exam cities, how many made it to the top 1.08 lakh and is there any skew in favour of those who registered on April 9 and 10.

The bench also questioned the Centre’s stand that the alleged leak of question papers in Hazaribagh had occurred just one hour before the start of the exam, and termed it far-fetched.

CJI has asked four questions to NTA: 1. How many centres were Canara bank papers distributed?

2. Out of those centres, in how many centres, were the correct question booklets (SBI paper) replaced?

3. How many centres were the papers evaluated for Canara bank papers?

4. Once the Canara bank papers were evaluated, how did the candidates fare?

Moreover, the petitioners' counsel informed the apex court that NTA admitted to paper leak, dissemination of leaked question paper through WhatsApp, as per PTI. "Statements are at variance. One statement says the leak happened on the 4th night, second statement says it was received on WhatsApp on the 5th morning. Amit Anand's statements are at variance," said the CJI, as per LiveLaw.

CJI further said: "We don't have any material so far to show the leak was so widespread and spread across the country."

On July 22, NTA Counsel, Solicitor General admitted that wrong question paper booklets were distributed at eight centres across the country, but "the difficulty level is of the same level," so the NTA deemed it fit to let students continue appearing for the wrong question booklet. The number of candidates who got Canara bank paper are slightly over 3000, NTA Counsel admits.

Advocate Hooda said that 69 students scored above 650 and 241 got above 550. "Their city coordinators are owners of these schools. These are private schools and invigilators are the teachers of these private schools and it cannot be ruled out that there could be a nexus between the coaching centres and the private schools...its completely privatised. In Sikar, there are 48 private schools who are just affiliated by CBSE, not CBSE run."

CJI asks whether this be a "ground to cancel the exam in entirety or to cancel the exam in Sikar?

The Supreme Court on July 18 directed the National Testing Agency (NTA) to publish the results of all NEET-UG candidates by Saturday 12 pm on their website — city-wise and centre-wise, masking the identity of the aspirants.
