A first information report (FIR) was registered on December 5 following direction of the Bombay High Court on a criminal writ petition filed by complainant Kishor Kashinath Lashkare (30) through his lawyer Vidyadhar Koshe. As per the FIR,between October 27,1989 to December 5,2011,MHCL allegedly obtained Rs 3 crore loan by mortgaging 10 acre and 24 gunthas land on survey no. 111 in Kalas on Alandi Road, which was meant for Yerawada Gadi Wadar Co-Housing Society. The other builders in accordance with Sushil Mantri kept the construction work continued on the land, the FIR stated.

Lashkare and 180 members of the society purchased 10 acre and 24 gunthas of land in Kalas from Tryambak Damodar Rasane and Laxmishankar Balkrushna Rasane for Rs 19,000. Later, around 100 members of the society borrowed Rs 12.06 lakh as loan from Maharashtra State Co-Housing Finance Corporation Ltd for constructing homes but only 54 members could complete the construction work. Some members could not pay the loan, therefore the society gave development rights to Sushil Mantri who paid Rs 15 lakh as the balance of the loan to the Maharashtra State Co-Housing Finance Corporation Ltd. But Mantri borrowed loan by mortgaging the property without informing the society members.
