Litigants who spend years fighting legal battles for trivial road accident claims can heave a sigh of relief. District Judge Vijay Achliya has passed a judgment that all such cases would first go into a mediation stage,giving both parties an option to reach a compromise. If an agreement is not reached,the case would take its usual course.
According to the system initiated by the judge,an expert panel,with a judge as the facilitator,would counsel both the parties on arriving at a compromise. The parties usually involved in Motor Vehicles Act claims are insurance companies or private parties who need to pay compensation to the complainant.
Such cases are taken up by different courts,but now,all of them would be assigned to one court for the benefit of litigants.
When the court passes a judgment and orders the litigant to pay compensation to the complainant,the insurance company or a person an interest also has to be paid on the amount. If the parties strike an agreement during the mediation,the interest would be saved.
Commenting on the scheme,Advocate Sunil Honrao said,This plan is laudable as it would help people to settle cases earlier thereby avoiding long legal battles.
Advocate Harshad Nimbalkar added that since the courts were already overburdened,the time saved from such cases could be used for clearing the backlog.
