In jail,convicted for murder,but still corporator

Almost 18 months after the sessions court convicted BJP corporator Datta Khade in a murder case,he continues to be an elected member as administrative delay is hindering his disqualification from the House.

Almost 18 months after the sessions court convicted BJP corporator Datta Khade in a murder case,he continues to be an elected member as administrative delay is hindering his disqualification from the House. Khade is serving his sentence at the Yerawada Central Prison.

Datta Khade alias DK was awarded life sentence,along with two others,by additional sessions judge S S Phansalkar-Joshi on January 30,2009. The court ruled that the three were involved in the murder of former wrestler and construction material supplier Rajesh Pardeshi over business rivalry; the case was registered soon after the murder that took place in February 2004.

In April this year,Pune Municipal Corporation’s (PMC) general body empowered municipal commissioner Mahesh Zagade to refer Khade’s disqualification to the small cause court. Two months later,the proposal is yet to reach the court.

Advocate Manjusha Idhate,senior legal advisor (advocate-acting),PMC,said,“The proposal reached our department 10 days ago. After legal drafting,we will forward it to small cause court this week.”

Khade was elected as a corporator from Model Colony in 2007; in 2009 he was convicted by the court. After the conviction,BJP suspended him from the party in June,2009. The PMC served him a show-cause notice in August last year,the reply to which was unsatisfactory. Zagade then proposed the civic general body to decide on the disqualification.

However,in a meeting in April,the general body members refrained from taking any decision after it was brought to the notice of the House that the high court had directed the civic body to refer the matter to the small cause court.

In the past,the civic body had proposed disqualification of corporators Nitin Jagtap and Rajan Kachi for misconduct,but the move was withdrawn later.
